District Attorney Announces Blood Results for Driver in Fatal Crash

Toxicology tests for driver involved in crash which killed Rocky Point student reveal levels of marijuana.

Toxicology tests performed and analyzed by the Suffolk County Crime Laboratory for Thomas Smith, the Ridge man charged with driving while ability impaired by drugs after , have been announced by Suffolk County District Attorney Thomas Spota.

Blood results of Smith, 20, showed evidence of the active ingredient of marijuana and levels of marijuana metabolite, which is consistent with recent use.

The testing by the crime lab did not find any controlled substances in the defendant’s blood. Smith is currently released on $150,000 bond, according to the D.A.

Baumgartner, 17, of Rocky Point and Smith’s girlfriend, Jacqueline Salvador, 19, of Ridge, died in the crash when the vehicle struck a tree along William Floyd Parkway at 1:24 a.m April 14. The victims were ejected from the vehicle.

Smith remains charged with a misdemeanor count of driving while ability impaired by drugs and the investigation into the crash continues.
